AN ACT
relating to the boundaries and organization of the Spring Branch Area Management District. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The heading to Subchapter A, Chapter 777, Acts of the 78th Legislature, Regular Session, 2003, is amended to read as follows:
SUBCHAPTER A. SPRING BRANCH MANAGEMENT [AREA COMMUNITY IMPROVEMENT] DISTRICT
SECTION 2. Section 1(a), Chapter 777, Acts of the 78th Legislature, Regular Session, 2003, is amended to read as follows: (a) The Spring Branch Management [Area Community Improvement] District is a special district created under Section 59, Article XVI, Texas Constitution. SECTION 3. Section 2(2), Chapter 777, Acts of the 78th Legislature, Regular Session, 2003, is amended to read as follows: (2) "District" means the Spring Branch Management [Area Community Improvement] District. SECTION 4. Chapter 777, Acts of the 78th Legislature, Regular Session, 2003, is amended by adding Section 4A to read as follows: Sec. 4A. AMENDMENTS TO BOUNDARIES. (a) The following territory is excluded from the district: Any land within the district that is also within the boundaries of Reinvestment Zone No. 17, City of Houston, Texas, as of the effective date of the Act enacting this section. (b) The following tract of land is added to the district: BEGINNING at the intersection of the South boundary of the right of way of Interstate Highway 10 and the existing Southwest boundary of the district at the West boundary of the right of way of West Sam Houston Parkway; Thence, West along the South boundary of the right of way of Interstate Highway 10 to the West boundary of the right of way of Brittmore Road; Thence, North along the West boundary of the right of way of Brittmore Road to the North boundary of the right of way Tanner Road; Thence, East along the North boundary of the right of way of Tanner Road, continuing along the North boundary of the right of way of West Tidwell Road to the East boundary of the right of way of Hempstead Highway; Thence, Southeast to the intersection of the East boundary of the right of way of Hempstead Highway and the Northeast boundary of the district at the East boundary of the right of way of West 43rd Street; Thence, West along the boundary of district to the point it turns South along the West boundary of the right of way of West Sam Houston Parkway, and continuing South to the POINT OF BEGINNING. SECTION 5. Section 27, Chapter 777, Acts of the 78th Legislature, Regular Session, 2003, is amended to read as follows: Sec. 27. [INITIAL] DIRECTORS UNTIL 2007 OR 2009. (a) The [initial] board consists of the following persons: Pos. Jackson] (b) Of these [the initial] directors, the terms of directors appointed for positions 1 through 7 expire June 1, 2007 [2005], and the terms of directors appointed for positions 8 through 13 expire June 1, 2009 [2007]. (c) Section 12 of this subchapter does not apply to this section. (d) This section expires September 1, 2009 [2007]. SECTION 6. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.
