A JOINT RESOLUTION
proposing a constitutional amendment authorizing the legislature
to allocate an amount greater than one-fourth of the net revenue
from the tax on motor fuels sold to volunteer fire departments to
the available school fund.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Article VIII, Texas Constitution, is amended by
adding Section 7-c to read as follows:
Sec. 7-c. Notwithstanding Section 7-a of this article, the
legislature may allocate an amount greater than one-fourth of the
net revenue from the tax on motor fuels sold to volunteer fire
departments for their exclusive use to the Available School Fund.
If the legislature allocates less than the entire amount of net
revenue to the Available School Fund, the legislature shall
allocate the remaining net revenue for the purposes relating to
public roadways described in Section 7-a of this article.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 8, 2005.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment authorizing the
legislature to allocate an amount greater than one-fourth of the
net revenue from the tax on motor fuels sold to volunteer fire
departments to the available school fund."
