A JOINT RESOLUTION
proposing a constitutional amendment to abolish the office of
constable in San Saba County.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 18(e), Article V, Texas Constitution, is
amended to read as follows:
(e) The office of Constable is abolished in Mills County,
Reagan County, San Saba County, and Roberts County. The powers,
duties, and records of the office are transferred to the County
Sheriff.
SECTION 2. The following temporary provision is added to
the Texas Constitution:
TEMPORARY PROVISION. (a) The amendment of Section 18(e),
Article V, Texas Constitution, proposed by the 79th Legislature,
Regular Session, 2005, abolishing the office of constable in San
Saba County takes effect only if, at the statewide election at which
the amendment is submitted to and approved by the voters, a majority
of the voters of San Saba County voting on the question at that
election also favor the amendment. The amendment takes effect
January 1, 2006, if the conditions of this subsection are met.
(b) This provision expires January 2, 2006.
SECTION 3. This proposed constitutional amendment shall be
submitted to the voters at an election to be held on November 8,
2005. The ballot shall be printed to permit voting for or against
the proposition: "The constitutional amendment abolishing the
office of constable in San Saba County."
