A JOINT RESOLUTION
proposing a constitutional amendment authorizing casino gaming.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 47, Article III, Texas Constitution, is
amended by amending Subsection (a) and adding Subsection (f) to
read as follows:
(a) The Legislature shall pass laws prohibiting lotteries
and gift enterprises in this State other than those authorized by
Subsections (b), (d), [and] (e), and (f) of this section.
(f) The Legislature by general law may:
(1) authorize and regulate casino gaming conducted by
the holder of a license or permit issued by the State for that
purpose; and
(2) limit the locations at which casino gaming may be
conducted to territory in which a majority of qualified voters
voting on the question vote to permit casino gaming.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 8, 2005.
The ballot shall be printed to provide for voting for or against the
proposition: "The constitutional amendment to authorize casino
gaming in Texas and to permit the legislature to limit casino gaming
to areas that approve casino gaming by local option election."
