A JOINT RESOLUTION
proposing a constitutional amendment authorizing a county to impose
a local tax on the sale of gasoline.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Article III, Texas Constitution, is amended by adding Section 52j to read as follows:
Sec. 52j. (a) Notwithstanding any other provision of this
constitutions the legislature by general law may authorize a county
to enact a local tax on the sale of gasoline in the county for use by
the county for transportation purposes;
(b) Section 7-a, Article VIII, of this constitution does not
apply to a tax authorized by this section.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 8, 2005.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment authorizing a county to
impose a local tax on the sale of gasoline."
