A JOINT RESOLUTION
proposing a constitutional amendment to allow the legislature to authorize and govern the sale of alcoholic beverages by certain restaurants in this state. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 20, Article XVI, Texas Constitution, is amended by adding Subsection (e) to read as follows: (e) The legislature may enact laws and direct the Alcoholic Beverage Commission or its successor to set policies for allowing the sale of alcoholic beverages for on-premises consumption by a food service establishment that derives 50 percent or less of the establishment's gross receipts from the sale of alcoholic beverages, regardless of whether the establishment is located in an area in which the sale of alcoholic beverages has or has not been authorized by a local option election. SECTION 2. This proposed constitutional amendment shall be submitted to the voters at an election to be held November 8, 2005. The ballot shall be printed to permit voting for or against the proposition: "A constitutional amendment to allow the legislature to enact laws authorizing and governing the sale of alcoholic beverages by certain restaurants in this state."
