R E S O L U T I O N
BE IT RESOLVED by the House of Representatives of the State of Texas, 79th Legislature, Regular Session, 2005, That House Rule 13, Section 9(a), be suspended in part as provided by House Rule 13, Section 9(f), to enable the conference committee appointed to resolve the differences on House Bill 1772 (permitting a general-law municipality to annex land in certain circumstances) to consider and take action on the following matter: House Rule 13, Section 9(a)(4), is suspended to permit the committee to add a new Subdivision (7) to Section 43.033(a), Local Government Code, that requires a general-law municipality to offer a development agreement to a landowner before annexing land that is appraised for ad valorem tax purposes as agricultural or wildlife management use, to read as follows: (7) if the area is appraised for ad valorem tax purposes as land for agricultural or wildlife management use under Subchapter C or D, Chapter 23, Tax Code: (A) the municipality offers to make a development agreement with the landowner in the manner provided by Section 212.172 that would: (i) guarantee the continuation of the extraterritorial status of the area; and (ii) authorize the enforcement of all regulations and planning authority of the municipality that do not interfere with the agricultural or wildlife management use of the area; and (B) the landowner fails to accept an offer described by Paragraph (A) within 30 days after the date the offer is made. Explanation: This change is necessary to protect owners of property that is appraised as agricultural or wildlife management use for property tax purposes from annexation by a municipality in a manner that would interfere with the use of the land for agricultural or wildlife management purposes.
