A BILL TO BE ENTITLED

AN ACT

relating to certain elevated projects of the Texas Department of 
Transportation.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter H, Chapter 201, Transportation Code, 
is amended by adding Section 201.617 to read as follows:
	Sec. 201.617.  PROHIBITION ON CERTAIN ELEVATED PROJECTS.  
The department may not:
		(1)  construct, improve, or maintain an elevated 
section of a highway if the section is more than one-half mile in 
length and located above a public park in a county with a population 
of at least two million; or
		(2)  elevate a section of a highway if the section is 
more than one-half mile in length and located above a public park in 
a county with a population of at least two million.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
