                                                                  S.B. No. 48 




AN ACT
relating to reporting requirements for convalescent and nursing homes and related institutions. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 242.403, Health and Safety Code, is amended by amending Subsection (b) and adding Subsection (c) to read as follows: (b) The department may require an institution to submit information to the department, including Minimum Data Set Resident Assessments, necessary to ensure the quality of care in institutions. Information submitted to the department that identifies a resident of an institution is confidential and not subject to disclosure under Chapter 552, Government Code. (c) The department may adopt standards in addition to those required by Subsection (a) to implement Sections 242.401 and 242.402. SECTION 2. Section 32.028, Human Resources Code, is amended by adding Subsection (n) to read as follows: (n) The commission shall ensure that rules governing the determination of rates paid for nursing home services provide for the reporting of all revenue and costs, without regard to whether a cost is an allowable cost for reimbursement under the medical assistance program, except: (1) as provided by Subsection (h); and (2) a penalty imposed under this chapter or Chapter 242, Health and Safety Code. SECTION 3. This Act takes effect September 1, 2005.
