A BILL TO BE ENTITLED

AN ACT

relating to reporting requirements for licensed nursing homes.                
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 242.049(c), Health and Safety Code, is 
amended to read as follows:
	(c)  The department shall adopt rules requiring all [All] 
licensed nursing homes in the state [may be required] to submit 
information designated by the department, including minimum data 
set reports, as necessary to improve the quality of care in nursing 
homes.  Information collected under this subsection that is also 
collected under federal law is subject to the other provisions of 
this section only to the extent consistent with federal law.
	SECTION 2.  This Act takes effect September 1, 2005.
