A BILL TO BE ENTITLED
AN ACT
relating to the removal of a member of a junior college district board of trustees for failure to attend board meetings. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter E, Chapter 130, Education Code, is amended by adding Section 130.0845 to read as follows: Sec. 130.0845. REMOVAL OF TRUSTEE FOR NONATTENDANCE OF BOARD MEETINGS. (a) It is a ground for removal of a member of the board of trustees of a junior college district that the member is absent from more than half of the regularly scheduled board meetings that the member is eligible to attend during a calendar year, not counting an absence for which the member is excused by a majority vote of the board. (b) The validity of an action of the board of trustees is not affected by the fact that the action is taken when a ground for removal of a member of the board exists. (c) A member of a board of trustees may be removed for a ground provided by this section, using the procedures provided by Subchapter B, Chapter 87, Local Government Code, for removing a county official. SECTION 2. The change in law made by this Act applies to an individual who is elected or appointed to the board of trustees of a junior college district before, on, or after the effective date of this Act. SECTION 3. This Act takes effect September 1, 2005.
