A BILL TO BE ENTITLED
AN ACT
relating to the composition of a board of adjustment in certain
municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subsections (a) and (b), Section 211.014, Local
Government Code, are amended to read as follows:
(a) This section applies only to a municipality with a
population of 500,000 [1.18 million] or more.
(b) A board of adjustment shall consist of one or more
panels of at least five members each to be appointed for terms of
two years. If more than one panel of the board is appointed, the
board consists of the regular members of all of the panels. The
board may adopt rules for the assignment of appeals to a panel.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
