A BILL TO BE ENTITLED
AN ACT
relating to including lactation education in public elementary and secondary school curriculum. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 28.002, Education Code, is amended by adding Subsection (o) to read as follows: (o) The State Board of Education, in consultation with the Texas Department of State Health Services, shall develop lactation education programs that a school district shall use in elementary and secondary schools as part of the science curriculum under Subsection (a)(1)(C) or the health curriculum under Subsection (a)(2)(B). SECTION 2. (a) Not later than May 1, 2006, the State Board of Education shall develop lactation education programs as provided by Section 28.002(o), Education Code, as added by this Act. (b) A school district shall use the lactation education programs developed by the State Board of Education as provided by Section 28.002(o), Education Code, as added by this Act, beginning with the 2006-2007 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
