A BILL TO BE ENTITLED
AN ACT
relating to additional state funding for certain juvenile justice alternative education programs. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 37, Education Code, is amended by adding Section 37.0121 to read as follows: Sec. 37.0121. ADDITIONAL STATE FUNDING FOR CERTAIN JUVENILE JUSTICE ALTERNATIVE EDUCATION PROGRAMS. (a) This section applies only if Chapter 41, as that chapter existed on January 1, 2005, is repealed by the 79th Legislature and is not replaced with comparable provisions for the transfer of money from school districts of relatively high wealth to school districts of less wealth. (b) A juvenile justice alternative education program is entitled to state aid in an amount equal to the total amount of money received from school districts during the 2004-2005 school year as a result of agreements under Section 41.121, as that section existed on January 1, 2005. (c) State aid provided under this section is in addition to any other state funding otherwise provided to juvenile justice alternative education programs. (d) The commissioner shall determine the amount of money to which a juvenile justice alternative education program is entitled under this section. A determination by the commissioner is final and may not be appealed. SECTION 2. This Act takes effect September 1, 2005.
