A BILL TO BE ENTITLED
AN ACT
relating to local government authorization of charitable solicitation by a pedestrian. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 552.007(a), Transportation Code, is amended to read as follows: (a) A person may not stand in a roadway to solicit a ride, contribution, employment, or business from an occupant of a vehicle, except that a person may stand in a roadway to solicit a charitable contribution if authorized to do so by the local authority having jurisdiction over the roadway. The local authority shall grant this authorization if the organization for which the solicitation is to be made provides to the local authority advance proof of liability insurance in the amount of at least $1 million to cover damages that may arise from the solicitation. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
