A BILL TO BE ENTITLED
AN ACT
relating to reports of strategies for increasing minority
participation in higher education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Subchapter H, Chapter 51,
Education Code, is amended to read as follows:
SUBCHAPTER H. GUIDELINES FOR ACADEMIC AND OTHER REPORTS BY
INSTITUTIONS OF HIGHER EDUCATION
SECTION 2. Subchapter H, Chapter 51, Education Code, is
amended by adding Section 51.4032 to read as follows:
Sec. 51.4032. ANNUAL REPORT OF MINORITY PARTICIPATION IN
HIGHER EDUCATION. (a) For purposes of this section, a racial or
ethnic group is underrepresented in the undergraduate or graduate
student body of an institution of higher education if the
percentage of that student body consisting of members of the racial
or ethnic group is less than the percentage of the population of
this state consisting of members of that racial or ethnic group.
(b) Not later than July 1 of each year, each institution of
higher education shall submit a report to the Texas Higher
Education Coordinating Board detailing its strategies for
increasing the number of undergraduate and graduate students who
enroll in the institution from racial and ethnic groups that are
underrepresented in the institution's undergraduate or graduate
student body. The report must include:
(1) the number of students from each racial or ethnic
group who apply to, are admitted or denied admission to, and enroll
in the institution as undergraduate and graduate students; and
(2) the specific outreach programs, admissions
policies, and types of financial assistance used by the institution
to increase enrollment of students from any of those racial and
ethnic groups that are underrepresented in either student body.
(c) An institution's report must be in the form prescribed
by the coordinating board in consultation with the institution.
The coordinating board shall specify the racial and ethnic groups
that must be included in the report.
SECTION 3. Section 61.080(a), Education Code, is amended to
read as follows:
(a) The board shall collect data and maintain a database
relating to the participation of members of racial and ethnic
minority groups in this state in public higher education, including
data relating to:
(1) minority applications, recruitment, admissions,
retention, graduation, and professional licensing at both the
undergraduate and graduate levels; and
(2) the enrollment strategies reported to the board by
institutions of higher education under Section 51.4032.
SECTION 4. Each public institution of higher education in
this state shall submit the first report required by Section
51.4032, Education Code, as added by this Act, not later than July
1, 2006.
SECTION 5. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
