A BILL TO BE ENTITLED
AN ACT
relating to the disqualification of certain persons for
unemployment benefits.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 207, Labor Code, is
amended by adding Section 207.054 to read as follows:
Sec. 207.054. JUDICIAL BRIEFING ATTORNEYS. Benefits are
not payable to an individual based on services performed as a
briefing attorney for a court in this state if the individual:
(1) performed the services for not more than one year;
and
(2) had notice at the time the services began that the
individual's service as a briefing attorney would not exceed one
year.
SECTION 2. The change in law made by this Act by the
enactment of Section 207.054, Labor Code, applies only to
eligibility for unemployment compensation benefits based on an
unemployment compensation claim that is filed with the Texas
Workforce Commission on or after the effective date of this Act. A
claim filed before the effective date of this Act is governed by the
law in effect on the date the claim was filed, and the former law is
continued in effect for that purpose.
SECTION 3. This Act takes effect September 1, 2005.
