A BILL TO BE ENTITLED

AN ACT

relating to the eligibility of certain community supervision and 
corrections department employees, retired employees, and 
dependents of employees and retired employees to participate in the 
group benefits program for state employees.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 1551.114(a), Insurance Code, is amended 
to read as follows:
	(a)  In this section, "employee of a community supervision 
and corrections department" means an employee of a department 
established under Chapter 76, Government Code, in a county with a 
population of less than 3.2 million.
	SECTION 2.  Section 1551.114(a), Insurance Code, as amended 
by this Act, applies to a community supervision and corrections 
department on the effective date of this Act, except that a 
community supervision and corrections department may participate 
in the group benefits program for state employees until the date any 
contract or policy entered into by the community supervision and 
corrections department under the group benefits program that is 
enforceable or in effect on the effective date of this Act expires 
or terminates.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
