A BILL TO BE ENTITLED
AN ACT
relating to permits for the commercial composting of grease trap waste. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 361.428(e), Health and Safety Code, is amended to read as follows: (e) The permit to compost grease trap waste must: (1) meet the minimum standards of a permit issued under rules adopted under Subsection (b); and (2) require the grease trap waste to be dewatered at an authorized processing facility before it is composted. SECTION 2. (a) On or after January 1, 2006, a person may not commercially compost grease trap waste, as defined by the Texas Commission on Environmental Quality, unless the person holds a permit issued by the commission under Sections 361.428(d) and (e), Health and Safety Code. (b) Section 2, Chapter 596, Acts of the 78th Legislature, Regular Session, 2003, is repealed. SECTION 3. (a) Except as provided by Subsection (b) of this section, this Act takes effect September 1, 2005. (b) Section 2 of this Act takes effect January 1, 2006.
