A BILL TO BE ENTITLED
AN ACT
relating to voter eligibility and registration in El Paso County
Water Improvement District No. 1.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subtitle J, Title 6, Special District Local Laws
Code, is amended by adding Chapter 9303 to read as follows:
CHAPTER 9303. EL PASO COUNTY WATER
IMPROVEMENT DISTRICT NO. 1
SUBCHAPTER A. GENERAL PROVISIONS
Sec. 9303.001. DEFINITION. In this chapter, "district"
means the El Paso County Water Improvement District No. 1.

SUBCHAPTER B. ADMINISTRATIVE PROVISIONS
Sec. 9303.051. VOTER ELIGIBILITY. An individual is
eligible to vote in a district election only if the individual:
(1) is 18 years of age or older;
(2) is a United States citizen; and
(3) is registered to vote under Section 9303.052.
Sec. 9303.052. ELIGIBILITY TO REGISTER. (a) To be eligible
for registration as a voter in the district, an individual must:
(1) be registered to vote in El Paso County, Texas; and
(2) either:
(A) hold title to land that is:
(i) taxable by the district; and
(ii) classified by the district as
irrigable; or
(B) have an ownership interest in an entity that
holds title to land that has received irrigation water from the
district within the previous four calendar years and is taxable by
the district.
(b) To vote in a district election, an individual eligible
to vote under Section 9303.051 must register with the district not
later than the 60th day before the date on which the district
election is held.
(c) The district shall file with the county clerk of El Paso
County a certified copy of the list of the district's registered
voters not later than the 25th day before the date on which a
district election is held.
SECTION 2. This Act takes effect September 1, 2005.
