A BILL TO BE ENTITLED
AN ACT
relating to the authority of a political subdivision to require a building permit for construction and renovation work on county-owned buildings and facilities. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 245, Local Government Code, is amended by adding Section 245.0051 to read as follows: Sec. 245.0051. CONSTRUCTION AND RENOVATION WORK ON COUNTY-OWNED BUILDINGS OR FACILITIES IN CERTAIN COUNTIES. (a) This section applies only to a county with a population of 3.2 million or more. (b) A political subdivision is not authorized to require a county to notify the political subdivision or obtain a permit for any new construction or renovation work performed within the limits of the political subdivision by the county on county-owned buildings or facilities if such construction or renovation work is overseen and inspected by a registered professional engineer or architect licensed in this state. (c) This section does not exempt a county from complying with a political subdivision's standards when performing construction or renovation work. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
