A BILL TO BE ENTITLED

AN ACT

amending Section 11.085, Water Code, by adding Subsection (w) 
relating to interbasin transfers of water rights within certain 
regional water planning areas; and declaring an emergency.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  That Section 11.085, Water Code, is amended by 
adding Subsection (w) to read as follows:
	(w)  The provisions of Subsections (s) and (t) of this 
section do not apply to a proposed transfer between river basins 
that are located within a single regional water planning area 
designated in accordance with Section 16.053 of this code if such 
regional water planning area contains within its boundaries:
	(1)  all or any portion of a county with a population of more 
than 3.3 million, according to the most recent federal census; and
	(2)  all or any portion of at least three river basins.                 
	SECTION 2.  That the importance of this legislation and the 
crowded condition of the calendars in both houses create an 
emergency and an imperative public necessity that the 
constitutional rule requiring bills to be read on three several 
days in each house be suspended, and this rule is hereby suspended, 
and that this Act take effect and be in force from and after its 
passage, and it is so enacted.
