A BILL TO BE ENTITLED
AN ACT
relating to computation of average daily attendance for certain
small school districts with declining enrollment.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 42.005(b), Education Code, is amended to
read as follows:
(b) A school district that experiences a decline of two
percent or more in average daily attendance shall be funded on the
basis of:
(1) the actual average daily attendance of the
preceding school year, if:
(A) the decline is the result of the closing or
reduction in personnel of a military base; or
(B) the district has fewer than 1,600 students in
average daily attendance in the current school year; or
(2) subject to Subsection (e), an average daily
attendance not to exceed 98 percent of the actual average daily
attendance of the preceding school year, if the decline is not the
result of the closing or reduction in personnel of a military base
and the district has 1,600 or more students in average daily
attendance in the current school year.
SECTION 2. This Act takes effect September 1, 2005.
