A BILL TO BE ENTITLED
AN ACT
relating to requiring notice to the prosecuting attorney before a
parole panel determines whether to release an inmate on medically
recommended intensive supervision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 508.146, Government Code, is amended by
adding Subsection (e-1) to read as follows:
(e-1) Not later than the 10th day before the date the Texas
Correctional Office on Offenders with Medical or Mental Impairments
presents information concerning an inmate to a parole panel to
determine whether to release the inmate on medically recommended
intensive supervision, the office shall notify by mail or fax the
attorney who represented the state in the prosecution of the
inmate's case, or that attorney's successor, that a parole panel is
considering the inmate's release on medically recommended
intensive supervision and that the attorney has 10 days from the
date the letter or fax is sent to provide the office with relevant
information concerning the inmate and the inmate's suitability for
release under this section. If the office receives information
under this subsection, the office shall forward that information to
the parole panel for consideration.
SECTION 2. The change in law made by this Act to Section
508.146, Government Code, applies to any release of an inmate under
that section on or after September 1, 2005.
SECTION 3. This Act takes effect September 1, 2005.
