A BILL TO BE ENTITLED
AN ACT
relating to cost allocations in power regions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.151(a), Utilities Code, is amended to
read as follows:
(a) A power region must establish one or more independent
organizations to perform the following functions:
(1) ensure access to the transmission and distribution
systems for all buyers and sellers of electricity on
nondiscriminatory terms;
(2) ensure the reliability and adequacy of the
regional electrical network;
(3) ensure that information relating to a customer's
choice of retail electric provider is conveyed in a timely manner to
the persons who need that information; [and]
(4) ensure that electricity production and delivery
are accurately accounted for among the generators and wholesale
buyers and sellers in the region; and
(5) ensure that transmission congestion costs are
equally spread to all electric consumers in the region.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
