A BILL TO BE ENTITLED

AN ACT

relating to repair of motor vehicles under an auto insurance 
policy.        
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Article 5.07-1, Insurance Code,  is amended by 
adding Subsection (j) to read as follows:
	(j)  In this article, "insurer" means an insurance company, 
reciprocal or interinsurance exchange, mutual insurance company, 
capital stock company, county mutual insurance company, Lloyd's 
plan, or any other legal entity authorized to write auto insurance 
in this state. The term includes an affiliate, as described by this 
code, if that affiliate is authorized to write and is writing auto 
insurance.
	SECTION 2.  This Act applies only to an auto insurance policy 
that is delivered, issued for delivery, or renewed on or after 
January 1, 2006. An auto insurance policy that is delivered, issued 
for delivery, or renewed before January 1, 2006, is governed by the 
law as it existed immediately before the effective date of this Act, 
and that law is continued in effect for this purpose.
	SECTION 3.  This Act takes effect September 1, 2005.
