A BILL TO BE ENTITLED
AN ACT
relating to the determination of benefit wage credits for purposes
of unemployment compensation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subdivision (1), Subsection (d), Section
207.004, Labor Code, is amended to read as follows:
(1) "Benefit wage credits" means those wages used to
determine an individual's right to benefits. The term does not
include wages earned from an employer from which the individual's
last separation from employment before the date of the initial
claim was under circumstances for which the individual would be
disqualified for benefits under Section 207.044.
SECTION 2. The change in law made by this Act applies to
eligibility for unemployment compensation benefits based on an
unemployment compensation claim that is filed with the Texas
Workforce Commission on or after the effective date of this Act. A
claim filed before the effective date of this Act is governed by the
law in effect on the date the claim was filed, and the former law is
continued in effect for that purpose.
SECTION 3. This Act takes effect September 1, 2005.
