A BILL TO BE ENTITLED
AN ACT
relating to an administrative cost for the enforcement of the
collection of tolls in certain counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 284, Transportation Code,
is amended by adding Section 284.0691 to read as follows:
Sec. 284.0691. ADDITIONAL ADMINISTRATIVE COST IN CERTAIN
COUNTIES. (a) A county with a population of 3.3 million or more
may impose, in addition to other costs, $1 as an administrative cost
associated with collecting a toll or charge for each event of
nonpayment of a required toll or charge imposed under Section
284.069.
(b) Money collected under Subsection (a) shall be deposited
in the county treasury in a special fund to be administered by the
county attorney. Expenditures from the fund shall be at the sole
discretion of the attorney and may be used only to defray the
salaries and expenses of the attorney's office, but in no event may
the county attorney supplement his or her own salary from the fund.
SECTION 2. Subsections (d) and (e), Section 284.208,
Transportation Code, are repealed.
SECTION 3. The change in law made by this Act applies only
to an event of nonpayment of a required toll or charge occurring on
or after the effective date of this Act. An event of nonpayment of a
required toll or charge occurring before the effective date of this
Act is covered by the law in effect when the event occurred, and the
former law is continued in effect for that purpose.
SECTION 4. This Act takes effect September 1, 2005.
COMMITTEE AMENDMENT NO. 1
Amend SB 821 as follows:
1. After SUBSECTION 1, page 1, line 18, insert new SECTION 2
as follows:
SECTION 2. Section 284.2031, Transportation Code, is
amended by amending Subsection (c) and adding Subsection (d) to
read as follows:
(c) In a county with a population of 3.3 million or more,
money [Money] collected under Subsection (a) shall be deposited in
the county treasury in a special fund to be administered by the
county attorney or district attorney. Expenditures from this fund
shall be at the sole discretion of the attorney and may be used only
to defray the salaries and expenses of the prosecutor's office, but
in no event may the county attorney or district attorney supplement
his or her own salary from this fund.
(d) In a county with a population of less than 3.3 million,
money collected under Subsection (a) shall be deposited in the
general fund of the county.
2. Renumber the subsequent Sections accordingly.
