A BILL TO BE ENTITLED
AN ACT
relating to the maintenance and contents of certain computerized information systems relating to the criminal justice system. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 42.01, Code of Criminal Procedure, is amended by adding Section 9 to read as follows: Sec. 9. In addition to the information described by Section 1, the judgment should reflect: (1) the state identification number assigned by the Department of Public Safety to the defendant under Chapter 60; and (2) the tracking incident number (TRN) assigned under Article 60.07(b)(1) to the individual incident of arrest to which the judgment relates. SECTION 2. Subsection (a), Article 60.052, Code of Criminal Procedure, is amended to read as follows: (a) Information in the corrections tracking system relating to a sentence to be served under the jurisdiction of the Texas Department of Criminal Justice must include: (1) the offender's name; (2) the offender's state identification number; (3) the sentencing date; (4) the sentence for each offense by offense code and incident number; (5) if the offender was sentenced to imprisonment: (A) the unit of imprisonment; (B) the length of sentence for each offense; and (C) if multiple sentences were ordered, whether they were ordered to be served consecutively or concurrently; [and] (6) if a sentence other than a fine or imprisonment was ordered, a description of the sentence ordered; and (7) the tracking incident number (TRN) assigned under Article 60.07(b)(1) to the individual incident of arrest that is the basis of the offender's conviction. SECTION 3. Subsection (b), Section 509.004, Government Code, is amended to read as follows: (b) The division shall develop an automated tracking system that: (1) is capable of receiving tracking data from community supervision and corrections departments' caseload management and accounting systems; (2) is capable of tracking the defendant and the sentencing event at which the defendant was placed on community supervision by name or state identification number assigned by the Department of Public Safety to the defendant under Chapter 60, Code of Criminal Procedure, arrest charge code, and the tracking incident number assigned under Article 60.07(b)(1), Code of Criminal Procedure; (3) provides the division with the statistical data it needs to support budget requests and satisfy requests for information; and (4) is compatible with the requirements of Chapter 60, Code of Criminal Procedure, and the information systems used by the institutional division and the pardons and paroles division of the Texas Department of Criminal Justice. SECTION 4. The change in law made by this Act in amending Article 42.01, Code of Criminal Procedure, applies only to a judgment of a court that is entered on or after September 1, 2005. SECTION 5. The changes in law made by this Act in amending Article 60.052, Code of Criminal Procedure, and Section 509.004, Government Code, apply only to a criminal history record created for a defendant arrested for an offense committed on or after September 1, 2005. SECTION 6. This Act takes effect September 1, 2005.
