A BILL TO BE ENTITLED
AN ACT
relating to the effect of annexation of territory on the terms of members of the governing boards of certain junior college districts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 130.088, Education Code, is amended by adding Subsection (j-1) to read as follows: (j-1) Notwithstanding any contrary provision of Subchapter D, the annexation of territory by the district does not affect the term of office of a member of the governing board of the district who is serving on the date the annexation takes effect, regardless of the provision of Subchapter D providing authority for the annexation and regardless of whether the annexation alters any boundary of the trustee district from which the member is elected. For purposes of this subsection, "annexation" includes any method by which new territory is added to a junior college district. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
