A BILL TO BE ENTITLED
AN ACT
relating to the election of directors of the Wes-Tex Groundwater
Conservation District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subsection (e), Section 9, Chapter 1473, Acts of
the 77th Legislature, Regular Session, 2001, is amended to read as
follows:
(e) When the boundaries of [At the first election of the
district after] the county commissioners precincts are redrawn
under Section 18, Article V, Texas Constitution, a director in
office on the effective date of the change, or elected or appointed
before the effective date of the change to a term of office
beginning on or after the effective date of the change, shall serve
the term or the remainder of the term in the precinct to which
elected or appointed even though the change in boundaries places
the person's residence outside the precinct for which the person
was elected or appointed [eight new directors shall be elected to
represent the precincts. The directors elected shall draw lots to
determine which director from each precinct serves a two-year term
and which director from each precinct serves a four-year term].
SECTION 2. Chapter 1473, Acts of the 77th Legislature,
Regular Session, 2001, is amended by amending Section 11 and adding
Section 11A to read as follows:
Sec. 11. ELECTION OF DIRECTORS. [(a)] On the uniform
election date prescribed by Section 41.001, Election Code, in
November [first Saturday in May] of each even-numbered [the second]
year [after the year in which the district is authorized to be
created at a confirmation election, an election shall be held in the
district for the election of:
[(1) the at-large director and the director from each
precinct representing an incorporated area of the precinct to serve
four-year terms; and
[(2) one director from each precinct representing an
unincorporated area of the precinct to serve two-year terms.
[(b) On the first Saturday in May of each subsequent second
year following the election], the appropriate number of directors
shall be elected.
Sec. 11A. ELECTION OF DIRECTORS IN 2006 AND 2008. (a) On
the uniform election date prescribed by Section 41.001, Election
Code, in November 2006, an election shall be held in the district
for the election of the directors from Precincts 2 and 4 to serve
four-year terms expiring December 1, 2010.
(b) On the uniform election date prescribed by Section
41.001, Election Code, in November 2008, an election shall be held
in the district for the election of the at-large director and the
directors from Precincts 1 and 3 to serve four-year terms expiring
December 1, 2012.
SECTION 3. (a) The terms of the Wes-Tex Groundwater
Conservation District directors elected from Precincts 2 and 4 and
serving on the effective date of this Act expire December 1, 2006.
(b) The term of the Wes-Tex Groundwater Conservation
District director elected from the district at large and the terms
of the directors elected from Precincts 1 and 3 who are serving on
the effective date of this Act expire December 1, 2008.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
