A BILL TO BE ENTITLED
AN ACT
relating to the authority of a political subdivision to require the
operator of a tow truck to obtain a license or permit.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subsection (d), Section 643.201, Transportation
Code, is amended to read as follows:
(d) To protect the public safety, a [A] political
subdivision may [not] require a person who holds a driver's license
or commercial driver's license to obtain a license or permit for
operating a tow truck if [unless] the person performs [nonconsent]
tows in the territory of the political subdivision. A fee charged
for a license or permit may not exceed $15.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
