A BILL TO BE ENTITLED

AN ACT

relating to fees and charges imposed by the governing board of a 
public junior college district.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 54.002, Education Code, is amended to 
read as follows:   
	Sec. 54.002.  APPLICABILITY OF CHAPTER.  The provisions of 
this chapter apply to all institutions of higher education, except 
that as to junior colleges this chapter applies only to the extent 
provided by Chapter 130 or to the extent that a provision of this 
chapter expressly applies to junior colleges [Section 130.003(b) of 
this code].
	SECTION 2.  Subchapter A, Chapter 130, Education Code, is 
amended by adding Section 130.0037 to read as follows:
	Sec. 130.0037.  AUTHORITY TO CHARGE FEES.  The governing 
board of a public junior college district may charge and collect 
fees from students registered at the junior college under Sections 
54.503 and 54.504.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
