A BILL TO BE ENTITLED

AN ACT

relating to the group benefit plans provided to certain retired 
state and university employees and their dependents.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
	SECTION 1.  The board of trustees of the Employees 
Retirement System of Texas and the boards of regents of The 
University of Texas System and The Texas A&M University System 
shall jointly:
		(1)  review the changes in law made by Section 4.03, 
Chapter 366, and Section 2.08, Chapter 1266, Acts of the 78th 
Legislature, Regular Session, 2003, and Article 16, Chapter 3, Acts 
of the 78th Legislature, 3rd Called Session, 2003;
		(2)  develop an equitable and uniform plan for 
treatment of annuitants and retirees and their dependents, and 
particularly those retirees and annuitants described by Sections 
1551.102(i), 1551.111(e), 1551.112(c), and 1601.102, Insurance 
Code, that operates within existing state resources and is fair to 
the annuitants and retirees; and
		(3)  notwithstanding Sections 1551.102(i), 
1551.111(e), 1551.112(c), 1551.253, and 1601.102, Insurance Code, 
implement the plan developed under Subdivision (2) of this section.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
