A BILL TO BE ENTITLED
AN ACT
relating to establishing standards for analysis of tests for controlled substances required of defendants placed on community supervision. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 11, Article 42.12, Code of Criminal Procedure, is amended by adding Subsection (a-1) to read as follows: (a-1) A sample or specimen taken as part of a test for controlled substances required of a defendant placed on community supervision must be analyzed by a laboratory that is certified by the Substance Abuse and Mental Health Services Administration of the United States Department of Health and Human Services. SECTION 2. This Act takes effect September 1, 2005.
