A BILL TO BE ENTITLED
AN ACT
relating to the membership and terms of the board of directors of the Texas Environmental Education Partnership Fund. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subsections (a), (b), and (c), Section 5, Chapter 105, Acts of the 76th Legislature, Regular Session, 1999 (Article 2654-3g, Vernon's Texas Civil Statutes), are amended to read as follows: (a) The board consists of not more than 11 [12] members appointed as follows: (1) nine [10] members appointed by the governor to provide balanced representation from the following groups: (A) business and industry; (B) agriculture; (C) nongovernmental organizations; (D) K-12 educators; (E) university educators; (F) local and state government; (G) environmental education providers; (H) environmental groups; and (I) parents; (2) one member appointed by the lieutenant governor to represent the senate; and (3) one member appointed by the governor selected from a list of persons recommended for membership by the speaker of the house of representatives to represent the house of representatives. (b) The group of nine [10] members appointed by the governor under Subsection (a)(1) of this section shall be culturally, ethnically, and geographically diverse. (c) Board members serve staggered six-year terms with the terms of three or four members [A board member is appointed for a renewable term of two years] expiring February 1 of each odd-numbered year. SECTION 2. Notwithstanding the changes in law made by this Act, all members of the board of directors of the Texas Environmental Education Partnership Fund serving on the effective date of this Act continue to serve until their terms expire February 1, 2007. In making appointments to the board under Section 5, Chapter 105, Acts of the 76th Legislature, Regular Session, 1999 (Article 2654-3g, Vernon's Texas Civil Statutes), as amended by this Act, for the terms beginning February 1, 2007, the lieutenant governor shall appoint one board member to represent the senate for a term that expires February 1, 2013, and the governor shall appoint: (1) one board member selected from a list of persons recommended for the position by the speaker of the house of representatives to represent the house of representatives to serve a term that expires February 1, 2013; and (2) nine board members of the governor's choosing to represent the groups identified by Subsection (a), Section 5, Chapter 105, Acts of the 76th Legislature, Regular Session, 1999 (Article 2654-3g, Vernon's Texas Civil Statutes), as amended by this Act, so that: (A) two of those board members serve terms that expire February 1, 2013; (B) four of those board members serve terms that expire February 1, 2011; and (C) three of those board members serve terms that expire February 1, 2009. SECTION 3. This Act takes effect September 1, 2005.
