A BILL TO BE ENTITLED

AN ACT

relating to actions of the Commission on Jail Standards regarding 
certain county jails operating in excess of total capacity.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 511.0101, Government Code, is amended by 
adding Subsection (c) to read as follows:
	(c)  The commission may not adopt the order described by 
Subsection (b) if, during any month in the three-month period 
described by Subsection (b), the number of prisoners confined in 
the county jail awaiting transfer to a facility of the Texas 
Department of Criminal Justice is equal to or greater than the 
number of prisoners by which the capacity of the county jail is 
exceeded.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect on the 91st day after the last day of the 
legislative session.
