A BILL TO BE ENTITLED

AN ACT

relating to the authority of certain local governments to use the 
design-build method of construction to construct a water 
desalination plant.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter H, Chapter 271, Local Government 
Code, is amended by adding Section 271.1191 to read as follows:
	Sec. 271.1191.  USE OF DESIGN-BUILD CONTRACT TO CONSTRUCT 
WATER DESALINATION PLANT.  (a)  Notwithstanding Section 271.111(7), 
a governmental entity, including a water utility owned by a 
governmental entity, may use the design-build method described by 
Section 271.119 for the construction of a water desalination plant.
	(b)  For purposes of this section, "facility" under Section 
271.119 includes a water desalination plant.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
