A BILL TO BE ENTITLED
AN ACT
relating to the authority of a municipality to enforce a water pollution control and abatement program and establish standards and practices for water quality. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 26.177, Water Code, is amended by adding Subsection (a-1) to read as follows: (a-1) Notwithstanding any other law, a city may enforce a water pollution control and abatement program adopted by the city before June 1, 2005, only to ensure compliance with commission pollution and degradation standards and practices and with commission rules. The city does not have the authority of the commission to regulate water quality, issue permits, or establish standards and practices for water quality. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
