A BILL TO BE ENTITLED

AN ACT

relating to delivery of alcoholic beverages by and to a winery.               
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 16, Alcoholic Beverage Code, is amended 
by adding Section 16.09 to read as follows:
	Sec. 16.09.  DELIVERY BY OR TO WINERY.  Notwithstanding 
Section 105.01 or any other provision of this code, the holder of a 
winery permit may deliver to or accept delivery from a holder of a 
permit under this code at any time.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
