A BILL TO BE ENTITLED
AN ACT
relating to payment for livestock feeding and care charges. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 148, Agriculture Code, is amended by adding Section 148.031 to read as follows: Section 148.031. LIENS FOR FEEDING AND CARE CHARGES FOR ANIMALS. (a) To secure all or part of the costs for feeding and care provided by an animal feeding facility for an animal being fed in confinement for slaughter, such facility has by operation of this section a lien on each such animal and on any of the products derived from such animal, and on any proceeds from any disposition thereof. (b) A lien under this section attaches when the feed and care are first provided, without further action. After it attaches this lien does not depend on possession by the animal feeding facility. (c) A lien under this section has priority over any other lien or security interest, whether or not perfected, in the animal, and on any of the products derived from such animal, and on any proceeds from any disposition thereof, whether or not such liens or interests were created or perfected before the attachment of the lien created by this section. (d) The person who acquires an interest in an animal, on any of the products derived from such animal, and on any proceeds from any disposition thereof which are subject to the lien provided by this section shall pay the feeding and care charges to the animal feeding facility, which shall pay the excess funds to the persons entitled to the same.
