A BILL TO BE ENTITLED
AN ACT
relating to prerequisites to an institution of higher education increasing designated tuition. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 54.0513, Education Code, is amended by adding Subsection (g) to read as follows: (g) Notwithstanding Subsection (a) and except as provided by this subsection, a general academic teaching institution may not increase the amount of tuition charged under this section for any program or course level unless the Legislative Budget Board has conducted a performance review of the institution as provided by Section 322.0165, Government Code, and reported the board's findings and recommendations to the institution relating to the appropriateness and effects of the tuition increase. This subsection applies to an institution only if: (1) the institution increased tuition under this section for the same program or course level for the preceding academic year by more than 20 percent from the academic year preceding that academic year; (2) the percentage of first-time undergraduate students who graduated from the institution within six years of the students' initial enrollment in the institution is less than 50 percent, as determined by the Texas Higher Education Coordinating Board for the most recent six-year period for which that information is available; and (3) the percentage of first-time undergraduate students of the institution who failed to meet success initiative assessment standards on initial assessment under Section 51.3062 is greater than 50 percent, as determined by the Texas Higher Education Coordinating Board for the most recent academic year for which that information is available. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
