A BILL TO BE ENTITLED

AN ACT

relating to termination or suspension without pay of a teacher who 
does not request an independent hearing examiner.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 21.211, Education Code, is amended by 
adding Subsection (b-1) to read as follows:
	(b-1)  The board of trustees shall notify the teacher in 
writing of an action proposed under Subsection (a) or (b).  If the 
teacher does not request a hearing within the time prescribed by 
Section 21.253, the board of trustees shall:
		(1)  take the appropriate action; and                                  
		(2)  notify the teacher in writing of the action not 
later than the 30th day after the date the board sent notice of the 
proposed action.
	SECTION 2.  The change in law made by this Act applies only 
to a termination or suspension without pay of a teacher on or before 
September 1, 2005.  A termination or suspension before that date is 
governed by the law in effect at the time of the termination or 
suspension, and the former law is continued in effect for that 
purpose.
	SECTION 3.  This Act takes effect September 1, 2005.
