A BILL TO BE ENTITLED
AN ACT
relating to the discharge of teachers for good cause under a probationary contract in a public school. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 21.104(a), Education Code, is amended to read as follows: (a) A teacher employed under a probationary contract may be discharged at any time for good cause as determined by the board of trustees, good cause being the failure to meet the generally accepted standards of conduct for the profession [as generally recognized and applied in similarly situated school districts in this state]. SECTION 2. Section 21.104(a), Education Code, as amended by this Act, applies only to a discharge under a probation contract for which written notice of the proposed discharge is given to a teacher on or after September 1, 2005. A discharge under a probation contract for which written notice of the proposed discharge is given to a teacher before September 1, 2005, is governed by the law in effect when the notice is given, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2005.
