A BILL TO BE ENTITLED
AN ACT
relating to the provision of law enforcement and fire protection
within certain districts providing potable water or sewer service.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 49, Water Code, is amended by adding
Section 49.446 to read as follows:
Sec. 49.466. Law Enforcement and Fire Protection in Certain
Districts.
(a) This section applies only to a district which (i)
contracts for or employs peace officers, (ii) maintains a fire
department, (iii) has within its boundaries a private airport with
a runway exceeding 5900 feet in length, (iv) has a hotel within its
boundaries, and (v) is located in two counties.
(b) The area within a district described in Subsection (a)
may not be included within the boundaries of a political
subdivision that provides law enforcement or fire protection
services other than the counties it is located without the consent
of the district.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
