A BILL TO BE ENTITLED
AN ACT
relating to taxes, assessments, and impact fees imposed on residential property by the Greater East End Management District. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 3807.157, Special District Local Laws Code, is amended to read as follows: Sec. 3807.157. PROPERTY EXEMPT FROM IMPACT FEES AND ASSESSMENTS. (a) The district may not impose a tax, impact fee, or assessment on a [residential property,] multiunit residential property consisting of fewer than 13 units[, or condominium]. (b) The district may not impose an impact fee or assessment on the property, equipment, or facilities of a person that provides to the public cable television, gas, light, power, telephone, sewage, or water service. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
