A BILL TO BE ENTITLED
AN ACT
relating to fraudulent documents offered to the county clerk for filing. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 51.901, Government Code, is amended by adding Subsection (d) to read as follows: (d) If a county clerk believes in good faith that a document or instrument that purports to create a lien and that is offered or submitted for filing or for filing and recording is fraudulent, the clerk shall request the assistance of the county attorney to determine whether the document is fraudulent before filing or recording the document or instrument. SECTION 2. This Act takes effect September 1, 2005.
