A BILL TO BE ENTITLED
AN ACT
relating to the conveyance of certain state-owned real property in 
Cherokee County to the City of Rusk.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  AUTHORIZATION FOR CONVEYANCE.  (a)  The Texas 
General Land Office may convey, on behalf of the state, all of the 
interest of the state in the real property described by Section 2 of 
this Act and all improvements on the property to the City of Rusk.
	(b)  The General Land Office shall determine the amount of 
consideration due under this Act by determining the fair market 
value of the property.
	(c)  Proceeds from the sale shall be deposited to the credit 
of the Permanent School Fund.
	(d)  The commissioner of the General Land Office shall 
reserve ownership of all oil, gas, and other minerals in and under 
the real property and the right to remove the oil, gas, and other 
minerals, including the right to grant oil, gas, and mineral 
leases.
	(e)  Sections 31.1571 and 31.158, Natural Resources Code, 
and 533.084, Health and Safety Code, do not apply to the conveyance 
authorized by this section.
	SECTION 2.  PROPERTY DESCRIPTION.  The real property 
authorized for conveyance by Section 1 of this Act consists of the 
real property described as follows:  BEING up to 387.244 acres of 
land in the WILLIAM BARTEE SURVEY, ABSTRACT NO. 3, and the DANIEL 
JOSLIN SURVEY, ABSTRACT NO. 461, Cherokee County, Texas.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
