A BILL TO BE ENTITLED

AN ACT

relating to enabling the use of biofuels in Texas                             
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 382, Health and Safety 
Code, Section 382.0171, is amended to read as follows:
	Section 382.0171.  ALTERNATIVE FUELS AND SELECT-USE 
TECHNOLOGIES.  (a)  In adopting rules, the commission shall 
encourage and may allow the use of natural gas and other alternative 
fuels, as well as select-use technologies, that will reduce 
emissions.  Diesel fuel, otherwise compliant with state rules and 
standards shall be considered to remain compliant with these rules 
and standards.
	SECTION 2.  This Act takes effect July 1, 2005.
