A BILL TO BE ENTITLED

AN ACT


relating to enabling the use of biofuels in Texas.                          
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subsection (a), Section 382.0171, Health and 
Safety Code, is amended to read as follows:
	(a)  In adopting rules, the commission shall encourage and 
may allow the use of natural gas and other alternative fuels, as 
well as select-use technologies, that will reduce emissions.  
Diesel fuel otherwise compliant with state rules and standards 
shall be considered to remain compliant with these rules and 
standards.
	SECTION 2.  This Act takes effect July 1, 2005.
